The DUI Law team recently secured an excellent outcome for a client charged with Drink Driving at Chinchilla Magistrates Court.
Our client was charged with Mid Range Drink Driving, with a blood alcohol concentration reading of 0.119.
Given our client satisfied a number of prerequisites, they were eligible to apply for a work licence.
A work licence permits a person to drive during their licence disqualification for work purposes only.
The maximum licence disqualification for Mid Range Drink Driving is 12 months, with a mandatory minimum of 3 months.
That said, Magistrates have the power to double what they would otherwise impose when a work licence is applied for.
We drafted affidavit materials for both our client and their employer to sign, we had the client complete an online reformatory course, and we had them obtain character references based on a template which we provided.
We were ultimately successful in persuading the Magistrate to grant our client a work licence and to not go past a 4 month licence disqualification.
The work licence allows our client to drive for work purposes only throughout their 4 month licence disqualification.
